- When it comes to the services and goods they provide through this platform and the listings and advertisements they post there, REPs are in compliance with all legal requirements, including those set forth in the Real Estate (Regulation and Development) Act 2016;

- Every detail, including the location, property specs, and price, of the properties displayed on the Platform and provided by the REPs is true, current, and up-to-date; and

- By listing the properties on the website and/or mobile app, the REPs are giving Nayilocation.com permission to use and/or disseminate the listing details in any way, including on Nayilocation.com's other websites, platforms, and other platforms, as well as on the websites of any associates or third parties;

Disclaimers on the accuracy and legitimacy of the listings and material

- Any property or project should be authenticated by the user, who will also be responsible for verifying the property's title, built-up area, and appropriateness for purchase or rental in the form and at the expense of their own choosing.

Rent Terms & Conditions for Nayilocation Payment

Our Role

Nayilocation.com offers its registered users (henceforth referred to as Users) the ability to pay for their rentals using its mobile app and website (henceforth referred to as Platform). Razorpay, a third-party payment gateway, facilitates these payments. The User attests that there is a legitimate Lessor and Lessee connection between the User and the Beneficiary and that the amount being transferred through the Platform represents the actual rental value in accordance with the Agreement by using this platform to make rental payments. We are not involved in any way in the underlying transactions that take place between the User and the Beneficiary; all we are doing is offering a platform to help the User and the Beneficiary make these rental payments. If there are any applicable regulations pertaining to these payments, the User must abide by them. Non-compliance or default in these payments will be the User's responsibility. We do not provide any kind of banking or associated financial services; we are not a financial institution. To deliver the services and handle your transactions, we might enlist the help of one or more other parties. In relation to any such remittance, we neither represent the lessor nor the lessee nor any other interested party.

KYC

Nayilocation.com may request the necessary documentation or information about the User and the Beneficiary, including any document to support the relationship between the Lessor and the Lessee, even though it will be entirely your responsibility to verify the legitimacy of the transaction. For instance, a PAN card, an Aadhar card, a rental agreement, etc. When a transfer exceeds INR50,000, the User will be asked to submit their PAN card data or any other documentation that may occasionally be needed by law.

You give Nayilocation permission to retrieve your Aadhaar XML from the UIDAI website in order to confirm your KYC information during Aadhaar-based verification.

Authorization

By starting this transaction on the Platform, you give us permission to retain, receive, and distribute money to the Beneficiary's selected bank account in line with your payment instructions. With your consent, we may charge the specified amount to your bank account, credit card, UPI account, debit card, payment wallet, or any other payment instrument that our platform may occasionally enable in order to transfer the funds to the beneficiary's selected bank account. You give us permission to commit your payment (minus any applicable fees, Service Charges, or any sums we may collect under this Agreement) to the Beneficiary when you give us instructions to pay them. If you provide insufficient information that prevents the transaction from being completed, we will refund the money to you after subtracting the relevant transaction fees, service charges, and penalties.

Transaction terms:

You would be responsible for entering the correct bank accounts details of the Beneficiary at the time of making the transaction and in no circumstances, Nayilocation.com shall be held responsible for any wrongful credit due to incorrect bank details. The user would be responsible for any fraudulent transactions that happened through his bank account, credit card account, etc. by any third party due to his negligence and/or providing your bank or card details to any third party. In no circumstances, Nayilocation.com shall be held responsible for any such fraudulent transactions and no refund shall be made by Nayilocation.com once the money is successfully credited to the designated bank account of the Beneficiary. For any reason, including without limitation if we believe the transaction puts us at risk for financial or security issues or is unauthorised, fraudulent, suspicious, unlawful, in violation of this Agreement, disputeable, or otherwise unusual, we may delay, suspend, or reject a payment transaction.

Liability

You grant Nayilocation the right to assume no liability or responsibility for any problem or claim resulting from a disagreement of any kind between you, the recipient, or any financial institution. You

consent to hold Nayilocation.com harmless for any transactions you make using false information, etc., that are credited to the erroneous account. You pledge to defend Nayilocation.com, its affiliates, and its staff members completely against any claims or legal action brought by third parties or by government agencies.

Suspicious / Fraudulent transactions:

In the event that the User notices any suspicious or fraudulent activity, he is required to promptly report it to us. It is the User's obligation to maintain the full confidentiality of his financial information and to never divulge it to third parties. We will attempt to halt any suspicious or fraudulent transactions as soon as they are reported by taking the appropriate action. However, if the funds are credited to the Beneficiary's chosen bank account, as supplied by the User, we will not be responsible for any refunds or other payments to any individual or authority for such transactions.

Refunds :

If for any reason Nayilocation.com is unable to deposit the rent money into the Beneficiary's selected bank account, we will return the money to the original account from which the remittance was made. Once the funds have been successfully credited to the Beneficiary's selected bank account, Nayilocation.com will never be responsible for repaying or refunding the User the amount. Charge- backs: If a transaction is either (a) disputed by the Remitter, (b) reversed for any reason, (c) not authorised or we have reason to believe that the transaction was not authorised, or (d) purportedly unlawful or suspicious, the amount of the transaction may be charged back or reversed (a "Chargeback") from the Beneficiary. In such circumstances, the amount of any such chargeback as well as any related fees, fines, or penalties imposed by our affiliated Payment Network Gateways / Financial Institutions should be paid to us right away by the Recipient of the amount. When asked, the User/Beneficiality will pay for their own assistance to help us look into any disputed transactions that were conducted over our Platform. In the event that the Beneficiary decides to dispute any such Chargebacks connected to Cards, we shall help the User/Beneficiary to do so with the Network or issuing institutions. An irrevocable Chargeback may occur if the Beneficiary does not cooperate with our investigation of a transaction in a timely manner, including but not limited to noting the required paperwork within three business days of our request. The Beneficiary will be solely responsible for any chargebacks, and we will not be held accountable in any way.

Terms & Conditions that apply to content created by users

By accessing the content on Nayilocation.com, the user consents to the following:

- Content has been independently supplied by other Users, such as real estate brokers and sellers, and does not belong to Nayilocation.com.

- Nayilocation.com just acts as a platform for users to display their properties; as a result, the material is solely the responsibility of the individual Users. Nayilocation.com does not endorse the content and has no control over it.

- The user assumes all liability for any use or reliance on any Content or materials posted by other users on Nayilocation.com. Nayilocation.com disclaims all obligation for the authenticity,

completeness, correctness, and dependability of any user-generated content that is put on the website.

- The User acknowledges that the Content may contain offensive, dangerous, erroneous, or otherwise inappropriate material. In certain instances, the Content may also have been mislabeled or otherwise misleading.

- The User may report any Content to us at support@Nayilocation.com if he thinks it violates any laws or is inappropriate, and we will respond to it appropriately in a matter of 48 hours.

By uploading content to Nayilocation.com, the user consents to the following:

- We have made sure that no one's intellectual property rights or other laws are violated by the Content. Furthermore, we ensure that the Content does not feature any offensive content, including but not limited to: sexual activity, child abuse, hate speech, violence, harassment, nudity, fake news, promotion of drug use, self-harm of any kind, etc.

- We acknowledge that we are solely liable for the Content that we give Nayilocation.com.

Nayilocation.com is not responsible for the Content because it is not within its control.

- Nayilocation.com disclaims any responsibility to host or provide the Content.

- Nayilocation.com may remove or take down the Content at any time at its sole discretion if it has reasonable grounds to believe that it violates any laws, including those pertaining to copyright, trademarks, intellectual property misappropriation, impersonation, unlawful conduct, harassment, or potential harm to it, its users, or third parties. We will not object to Nayilocation.com's removal or takedown of any content.

- Nayilocation.com is granted the worldwide, non-exclusive, royalty-free, transferable, sublicensable right to use the Content that we provide (including for reproduction, distribution, creating derivative works, performance, and display).

- Listings, user information, leads, and other materials are considered corporate property and are available for use by the firm and any of its affiliates, partners, associates, and so on.

- Users consent to and authorise the company and any of its partners, affiliates, associates, etc. permission to contact them with promotional messages, SMS, calls, or offers of third-party products.
